Amazon's cover-up of third-party sellers selling counterfeit goods was confirmed by the court! Counterfeit products will have nowhere to hide

It is learned that according to foreign media reports, the Israel-based Maglula brand recently won the appeal against Amazon for selling counterfeit products, and Amazon was ruled by a US district court to be "confirmed to be selling counterfeit products."

 

The court ruling stated that evidence showed that Chinese third-party sellers on Amazon counterfeited Maglula products, packaging, labels and related documents, and Amazon allowed these products to be sold as authentic.


Low-quality knockoff products sold on Amazon were faulty, and Amazon buyers expressed their dissatisfaction directly to Maglula and sent the faulty products to Maglula. After receiving the products, Maglula learned that they were cheap knockoffs.

 

In this case, the court rejected multiple challenges to Amazon’s complaint and, in what may be a first for an intellectual property case against Amazon, approved mandatory inspections of Amazon warehouses over Amazon’s objections. Amazon also destroyed evidence after Maglula filed its complaint.

 

Amazon also claimed that it was not responsible for infringing Maglula’s intellectual property rights, attempting to put the blame entirely on third-party sellers, but the evidence Maglula collected showed that this claim was unfounded.

 

Maglula noted that genuine Maglula products are easily distinguishable from counterfeits, and Amazon can easily identify and protect consumers from purchasing counterfeits.

 

And Maglula has been trying to work with Amazon to resolve these issues for years, explaining to Amazon how to distinguish between genuine and fake products and hinting at stricter measures. Maglula even listed some of its trademarks on Amazon's brand registry, hoping that it would stop the sale of counterfeits. But Amazon still hasn't stopped offering, selling, and shipping counterfeit and knockoff products. In its complaint, Maglula even pointed out more than 40 counterfeit products that Amazon sells and ships to its customers.

Maglula has established a substantial counterfeiting case by collecting evidence, which is a historic victory. With this case, more and more brands will successfully defend their rights in the future, Amazon will also pay more attention to it, and the chances of third-party sellers selling counterfeit and shoddy products will be greatly reduced.

 

This is good news for sellers with brands, as it can help bad money drive out good money and create a better market environment.
