In order to implement the trademark brand strategy in depth, improve the level of trademark brand creation, protection and application, promote the transformation of Dongguan products into Dongguan brands, promote the transformation and upgrading of Dongguan's economy, and accelerate the realization of high-quality development, this regulation is formulated in accordance with relevant national and provincial regulations and in combination with the actual situation of Dongguan. Chapter I General Provisions

Article 1 These Measures are formulated in accordance with relevant national and provincial regulations and in light of the actual situation of this Municipality in order to implement the trademark and brand strategy in depth, improve the level of trademark and brand creation, protection, and utilization, promote the transformation of Dongguan products into Dongguan brands, promote the transformation and upgrading of Dongguan's economy, and accelerate the realization of high-quality development.

Article 2 The special funds for trademark and brand strategy (hereinafter referred to as "special funds") mentioned in these Measures refer to special funds arranged by the municipal fiscal budget for the implementation of trademark and brand strategy. The funding for the special funds shall be arranged from the special funds for the "Science and Technology Dongguan" project of Dongguan City.

Article 3 The management of special funds shall comply with the principles of openness and fairness, compliance with laws and regulations, highlighting key points, performance management and scientific allocation.

Article 4 Special funds shall be subject to budget management. The specific implementation shall be based on the scope of fund support, with project library management as the main principle, included in the annual budget preparation, and the use of funds shall be carried out in accordance with the budget approval documents.

Chapter II Departmental Responsibilities

Article 5 The Dongguan Municipal Market Supervision Administration (Intellectual Property Office) (hereinafter referred to as the "Municipal Market Supervision Administration") shall be responsible for the specific management of special funds according to the division of labor, and shall be responsible for the formulation and revision of specific management measures for special funds, application for establishment and adjustment of special funds, declaration of special fund budget, preparation of special fund allocation and use plan, handling of special fund disbursement, organization of project application, document review, organization of project acceptance, and project review work shall be organized and implemented in accordance with the "Management Measures for Expert Review of "Science and Technology Dongguan" Engineering Funded Projects"; according to the principle of "whoever uses, whoever is responsible", it shall be responsible for the safe use of special funds, supervision and inspection of special funds, performance evaluation of special funds, and disclosure of special fund information.

Article 6 The Dongguan Municipal Finance Bureau (hereinafter referred to as the "Municipal Finance Bureau") is responsible for formulating the budget management of special financial funds, organizing the preparation and implementation of special fund budgets; reviewing the compliance of special fund arrangement plans prepared by municipal-level business supervisory departments, and issuing special fund use plans; organizing and implementing special fund financial supervision and inspection and key performance evaluation, etc.

Chapter III Funding Scope and Conditions

Article 7 According to the policy measures of "Dongguan City's Opinions on Deeply Implementing the Trademark and Brand Strategy to Serve a Higher Starting Point and Achieve Higher Level of Development" (Dongfu [2018] No. 45), the scope of special funds includes: international trademark registration projects, domestic trademark registration projects, regional brand demonstration zone construction projects, China's well-known trademark projects and China Trademark Gold Award projects.

Article 8 The use of special funds includes post-award subsidies, standard-based funding, etc.

Article 9 Application Requirements

(1) The applicant does not fall under any of the circumstances that are not eligible for funding as stipulated in the Several Provisions on the Specific Scope of Non-Funding of Special Financial Funds for Science and Technology Development and Industrial Transformation and Upgrading in Dongguan City and related documents.

(2) The applicant does not fall under any of the circumstances that prohibit application or deny funding as stipulated in the “Financial Management Measures for Special Funds for the “Science and Technology Dongguan” Project of Dongguan City”.

(3) Owning its own trademark rights and having no ownership disputes, and the registered address of the trademark registrant is within the administrative area of ​​Dongguan City.

(IV) The application for international trademark registration should be based on my country as the basic registration place and the trademark approved for registration abroad through the Madrid International Trademark Registration System, the European Union, and the African Intellectual Property Organization.

(V) Main conditions for applying to build a regional brand demonstration zone:

1. Have strong industry influence and obvious competitive advantages in similar industries at home and abroad;

2. The trademark has been registered and registered with the Madrid International Registration Authority, and has become a public trademark resource in the region;

3. Formulate relevant cultivation plans based on local industrial clusters and local characteristics;

4. Have a good foundation for construction. Have a good foundation in development planning, quality standards, inspection and testing, continuous innovation, marketing promotion, application management, and use protection;

5. Sound management mechanism. Establish relevant leadership bodies, establish organizations covering the work of relevant departments, give full play to the joint efforts of the government, enterprises, social organizations, and professional institutions, and actively participate in the construction of industry organizations and backbone enterprises.

(VI) The funded projects must be in line with the development direction of the national trademark brand strategy.

Article 10 Evaluation procedures for regional brand demonstration zone construction projects

(1) The Municipal Market Supervision Bureau shall accept the application materials according to the application guidelines issued that year and prepare a list of applicants after conducting a formal review;

(II) According to the relevant provisions of the "Science and Technology Dongguan" Project Funding Expert Review Management Measures, the Municipal Science and Technology Association will organize experts to score and select a candidate list, which will then be discussed and approved by the Municipal Trademark and Brand Strategy Joint Conference to determine the list of selected projects;

(III) The shortlisted list will be published on the government website for 10 working days. During the publicity period, any unit or individual who has objections may submit them to the Municipal Market Supervision Bureau, which will request the Trademark and Brand Strategy Joint Conference to investigate and handle the objections. After the publicity period expires, the list with no objections or unfounded objections will be reported to the Municipal People's Government for approval and publication by the Municipal Trademark and Brand Strategy Joint Conference.

Article 11 The requirements for submitting application materials for each project shall be clearly stated in the annual application guidelines.

Chapter 4 Funding Methods and Standards

Article 12 Funding Methods and Standards

1. International Trademark Registration Project

1. For trademarks registered through the Madrid System, a one-time subsidy can be applied for after obtaining the Trademark Registration Certificate and being approved by each designated country. The maximum subsidy for each application shall not exceed 60% of the official trademark registration fee (calculated based on the country of successful registration), but shall not exceed RMB 50,000.

2. For patents registered with the European Union or the African Intellectual Property Organization, the funding for each patent shall not exceed RMB 10,000.

3. For products registered in a single country, Taiwan, Hong Kong or Macau, the funding for each product shall not exceed RMB 2,000.

The total amount of funding for the same trademark shall not exceed RMB 100,000.

(II) Domestic Trademark Registration Project

For those who obtain the registration certificate of geographical indication trademark or certification trademark, the maximum subsidy for each geographical indication trademark shall not exceed 200,000 yuan, and the maximum subsidy for each certification trademark shall not exceed 50,000 yuan. There shall be no duplication of funding for these two items.

(III) Regional brand demonstration zone construction projects

Organizations that meet the main conditions for applying to build regional brand demonstration zones will be provided with funding, with the maximum amount of funding not exceeding RMB 1 million.

(IV) China Well-known Trademark Project

Trademark registrants of "Well-known Chinese Trademarks" that have been administratively recognized will be given subsidies based on their actual corporate income tax paid in that year, not exceeding the local retention ratio at the municipal level, with a maximum subsidy amount of no more than RMB 1 million.

(V) China Trademark Gold Award Project

For winners of the China Trademark Gold Award, the maximum subsidy is RMB 5 million for the winners of the Trademark Innovation Award and the Trademark Utilization Award; the maximum subsidy is RMB 2 million for the winners of the Trademark Protection Award, and the maximum subsidy is RMB 200,000 for individuals. The winners of the Trademark Protection Award supported by the government will only be given honors, not cash rewards.

(VI) No further funding will be provided for trademark renewal upon expiration.

Article 13 After the funding list is determined, the Municipal Market Supervision Bureau will issue a funding allocation notice and allocate special funds in accordance with the funding budget management requirements.

Chapter V Budget Management

Article 14 If the special funds need to be adjusted or the scope of expenditure needs to be increased during the implementation period, they shall be submitted to the municipal government for approval in accordance with the procedures, and the required funds shall, in principle, be comprehensively solved within the total budget of the first-level projects. The application guide corresponding to the details of the second-level projects shall be formulated and issued by the Municipal Market Supervision Bureau and copied to the Municipal Finance Bureau.

Article 15 Special funds shall be subject to a double-entry approval system for annual usage quotas and specific project plans. The Municipal Market Supervision Bureau shall study and propose annual tasks based on the annual budget control quota, departmental business development plans and the degree of achievement of their goals, and the annual key tasks determined by the Municipal Party Committee and Municipal Government, and submit the list of special funds catalogs to the Municipal Finance Bureau for review when applying for the next year's budget.

Article 16 Special funds shall be budgeted in strict accordance with the Budget Law of the People's Republic of China and other provisions, and included in the annual budget draft for examination and approval in accordance with the law. The scope of use and performance targets of special funds approved through legal procedures shall serve as the basis for budget execution.

Chapter VI Funding Allocation and Implementation

Article 17 The Municipal Market Supervision Bureau, based on the work arrangements of the superior departments and the Municipal Party Committee and Municipal Government, focuses on the annual implementation of the trademark and brand strategy, and comprehensively considers the annual budget scale and the reserve of the project library. Within the scope of support, it selects key projects for declaration. The scope of projects selected for organization declaration each year shall be clearly stated in the annual declaration documents.

Article 18 The Municipal Market Supervision Bureau shall clarify important matters such as application materials, funding conditions, methods, and standards based on the annual budget approval. If the relevant application items comply with the implementation rules of the relevant special projects and the relevant documents, the application documents shall be directly issued; if the relevant application items need to adjust the existing document regulations or be determined on a case-by-case basis, the Municipal Market Supervision Bureau shall issue the application documents after obtaining approval from the municipal government in accordance with the procedures.

Article 19 When the Municipal Market Supervision Bureau amends this regulation, it shall conduct sufficient research in conjunction with the Municipal Finance Bureau and other relevant departments and submit the amendment to the municipal government for approval before making any amendments.

Article 20 Special funds shall, in principle, be managed through a project database. The Municipal Bureau for Market Regulation shall collect and reserve projects, classify and screen them, review and verify them, rank and select the best ones, and review and verify them to formulate a special fund funding plan, which shall be submitted to the Municipal Finance Bureau for review in accordance with relevant regulations.

Article 21 The Municipal Market Supervision Bureau may determine the final funding amount of the project in a reasonable manner within the prescribed funding limit based on the annual budget scale and the number of applications to ensure the performance of the special funds. The reasonable methods mainly include:

(1) Special funds in the annual budget will be used up in the order of application; if a project fails to obtain funding in the current year due to insufficient budget, the Municipal Market Supervision Bureau may arrange funding from the budget funds of the next year;

(ii) Based on the budget size and the number of project applications, the funding ratio and amount will be appropriately lowered without exceeding the maximum funding standard that the grantees can enjoy.

Chapter VII Funds Allocation and Management

Article 22 Funding Disbursement

(I) The special fund allocation is based on the budget approved by the Municipal People's Congress and is implemented in accordance with the provisions of the "Dongguan Municipal Special Fund Management Measures". After the funding plan is reviewed and approved, the application and disbursement procedures shall be handled in a timely manner in accordance with the financial fund allocation procedures.

(II) After the project funds are issued, the disbursement procedures shall be carried out according to the disbursement procedures of the fiscal budget amount. The funded units shall standardize the financial accounting management of various expenditures. After receiving the funding, accounting and account processing shall be carried out in accordance with the respective applicable accounting systems or accounting standards.

Article 23 Fund Management

(I) The subsidized units must participate in the monitoring of the economic operation of enterprises and, in accordance with the requirements of the Municipal Market Supervision Bureau, cooperate in providing data and information such as the implementation of projects and the production and operation of enterprises, so as to facilitate the follow-up tracking and supervision of special funds.

(II) The supervision and performance evaluation of special funds shall be carried out in accordance with the provisions of the "Financial Management Measures for Special Funds for the "Science and Technology Dongguan" Project of Dongguan City", the "Interim Measures for the Performance Evaluation Management of Special Funds for the "Science and Technology Dongguan" Project of Dongguan City", the "Management Measures for Special Funds at the Municipal Level of Dongguan City", and other documents. If the municipal government has other provisions, they shall be implemented in accordance with the relevant provisions.

Chapter VIII Supervision, Inspection and Performance Evaluation

Article 24 The supervision and management, performance evaluation, information disclosure and accountability of special funds shall be carried out in accordance with the regulations issued by the municipal government on the management of municipal special financial funds, financial management, performance evaluation, accountability, etc.

Article 25 During the process of the finance, audit, supervision and other functional departments performing relevant supervision, inspection and performance evaluation functions, the Municipal Market Supervision Bureau and the subsidized units shall cooperate and assist in providing relevant data or information.

Article 26 The subsidized units must effectively strengthen the management of the use of special funds, strictly implement financial rules and regulations and accounting methods, properly organize and preserve original financial and achievement vouchers and materials, and consciously accept supervision and inspection by the financial, auditing and supervisory departments.

Article 27 Project applicants must be responsible for the accuracy and authenticity of the materials they submit. If any illegal or irregular behavior is found, it will be handled in accordance with the Regulations on Punishment and Sanctions for Fiscal Violations.

Chapter IX Supplementary Provisions

Article 28 These Measures shall be interpreted by the Municipal Market Supervision Bureau.

Article 29 This Measures shall come into force on the date of publication and shall be valid until December 31, 2022. During the implementation process, it may be evaluated and revised in accordance with the law based on the implementation situation.
