1. Requirements for applying for a Hong Kong trademark

3. If applying as a legal person, please attach a copy of the business license or valid registration certificate; if applying as a natural person, please attach a copy of the personal ID card;

4. One clear copy of the trademark drawing;

5. Fill out one application form, which must be signed by the applicant or an agent

6. List the goods or services for which registration is sought and indicate the trademark category, which can be found in the trademark classification table on this website.

2. Hong Kong Trademark Registration Query

Anyone can use the free search website of the Hong Kong Government Intellectual Property Department at http://ipsearch.ipd.gov.hk to search for identical or similar registered Hong Kong trademarks and prior applications at any time.

If our company's written opinion makes a positive application suggestion, and after the application, the examiner objects due to the existence of confusingly similar trademarks, our company will refund all application fees.

Before reviewing the application, the Trademark Registry will first carefully examine the application form and all attachments to check whether the required parts of the form have been completed, whether the relevant information is correct, and whether the required information is incomplete. If everything is in order, the application process will enter the next stage (substantive examination stage).


III. Substantive Examination

After checking the deficiencies of the application and confirming that all the information is ready, the Trademark Registry will check the trademark records to determine whether other businesses have registered or applied to register the same or similar trademarks for the same or similar goods or services. The Trademark Registry will also check whether the trademarks concerned meet the registration requirements set out in the Trademark Ordinance.

If the review is passed, the application process will enter the next stage (constitutional announcement stage).


IV. Notice of Gazette

After the Trademark Registry approves the application, it will be announced in the Hong Kong Intellectual Property Gazette for a period of three months. If no one raises an objection, the trademark can be successfully registered.


5. Registration

Once the trademark registration application is approved, the detailed information of the trademark will be recorded in the register and a registration certificate will be issued to the applicant. In addition, the Director of the Trademark Registry will publish the relevant registration announcement in the Hong Kong Intellectual Property Gazette. The registration date will be traced back to the date of application submission. In other words, the rights of the owner of a registered trademark should be calculated from the date of application submission.
