However, what I want to tell you today is a small incident interspersed among various big news, but this small incident is related to the vital interests of sellers, especially sellers of clothing, shoes and hats need to pay special attention - the well-known American law firm GBC is about to take action again recently.

This time, GBC has targeted a word that is also very broad but has been registered as a trademark - "FOX". Fox is a very old sporting goods company that specializes in the design, development and production of sportswear and related sports accessories.

In 2009, Fox successfully acquired the "FOX" trademark, with the trademark registration category being 025 clothing, shoes and hats, valid until January 13, 2020.

GBC is a well-known organization for those who have worked for a long time. In 2017, it launched several intellectual property lawsuits against Chinese sellers, involving thousands of sellers on multiple cross-border e-commerce platforms. Most of the sellers accused by GBC had their funds frozen, and some even had their platform stores closed.

This time, GBC Law Firm has purchased some gloves and other products with the fox and FOX trademarks, and it is very likely that it has reached some kind of agency agreement with Fox.

There are still quite a lot of clothing, shoes and hats products on the platform that involve the FOX trademark and the fox trademark. Some sellers even use the word FOX in the title or details. These are all trademark infringements. GBC's action target this time will be this group of sellers. If there are clothing and shoes sellers involved, they should modify or remove their products now.

We Amazon sellers have experienced many times the ridiculous situation of using a broad and common word in the title or description, but it turned out to be an infringing word.

For example, the last adjective caught by GBC is POP . As an abbreviation of popular, it is often used to express popularity. Who would have thought that it is also a registered trademark?

In addition, the registered party PopSockets was suspected of maliciously filing infringement complaints. It cooperated with GBC at the first opportunity and even filed infringement complaints against mouse pad sellers that were not within its business scope, causing chaos in the industry.

In addition to the above cases where trademark owners contacted Amazon to protect their rights, the following situation is even more outrageous. The brand owner did not take the initiative to protect its rights (or even felt that it was not a big deal) , but Amazon felt that the seller had infringed the brand’s trademark rights and removed the related products from the shelves!

As a world-renowned diversified technology company, Minnesota Mining and Manufacturing (3M) has a leading position in core markets such as medical products, highway safety, office and educational products, and optical products. It also owns the ownership of trademarks including "3M" and "3m".

Although 3M is a giant, the infringing products in the picture do not overlap with 3M products. The 3m here obviously refers to the length of the product cable, and Amazon customer service obviously only saw the 3m and did not consider the actual scenario. Even after opening a case and explaining to customer service, the answer I got was

Of course, since this incident was not caused by the brand owner 3M’s rights protection, the seller only needs to modify the 3m in the product title or description. Changing it to 3 meters or 3.0m can restore the ASIN and avoid being removed from the shelves.

The last case is one of our seller trainees. It is somewhat similar to the case with 3m in the title above. Both are non-infringing products that were removed from the shelves because they contained brand words in the title/description.

In this case, Amazon will judge that your product is infringing or has misleading descriptions without the brand owner having to defend their rights, just like in the case of 3M. Amazon will remove the product from the shelves and require modification.

Those of you with sharp eyes should have noticed that, yes, most infringements like these can be restored in a short period of time by means of refurbishing the listings , and FBA products can be put back on the shelves for sale without having to move warehouses or change labels .
