Recently, many sellers reported that they received emails about their accounts being blocked and the funds in their accounts being frozen because they infringed on the rights to a BRISTLY dog chew stick.


It is understood that this case was initiated on December 17, and the plaintiff is Doggie Dental, Inc., a company established under California law that produces and sells various types of dog chew sticks. The brand involved in this case is BRISTLY, and the company sued BRISTLY for trademark, copyright and patent infringement .

As early as June 2019, the company launched a brand protection campaign, and hundreds of Amazon accounts were blocked at that time. This time, the company sued 151 Amazon accounts one after another.


BRISTLY Teething Stick was invented by a man named Dertsakyan and is exclusively licensed to Doggie Dental. As early as last year, the brand submitted an application for BRISTLY U.S. trademark registration, and the brand has registered multiple categories, including pet cleaning.

In addition to the trademark, the product has also applied for a design patent!


 

In addition, there are copyright infringements that sellers are not familiar with! Mainly product images, and pictures of dogs undergoing oral cleaning.

 

 

The complaints from brands this time are fierce, with more than 150 seller accounts being complained about, and the number is still increasing. Generally speaking, the settlement of law firms is based on either the amount of money frozen in the account or the number of infringing products sold. It is understood that the settlement money in this case is 50%-70% of the frozen amount, which means that the more money in the account, the greater the loss of the seller!


In fact, infringement is indeed a tricky issue for Amazon. It is difficult to file a complaint and the cost is high. Therefore, sellers must be careful when selecting products and operating them. They should first check whether the product has infringement risks on relevant websites. Otherwise, it will be very difficult to promote the product and it will be very painful to receive a complaint.
