Nintendo sues Amazon sellers!

Nintendo of America has filed a lawsuit against a Nintendo Switch hacker reseller on Amazon, as it has done in similar cases in the past. Nintendo's lawyers accused Amazon seller Le Hoang Minh of circumventing Nintendo's copyright measures to sell the RCM injector, which was used to "jailbreak" the Nintendo Switch console.

In the lawsuit, which Nintendo filed Wednesday in Seattle, Nintendo describes a "serious, growing international problem" with video game software piracy, according to court documents. It details Nintendo's security systems and how RCM injectors, essentially USB devices that plug into Nintendo Switch consoles, allow users to play so-called "pirated," or unauthorized, games.

According to the lawsuit, Nintendo sent a DMCA notice to the distributor, which counter-sued. Because of the counter-sued, Amazon had to re-list the RCM Injector unless Nintendo filed an infringement lawsuit, which it did.

Nintendo is seeking a court order to stop the distributor and award it $2,500 in damages for each infringement. This is consistent with two previous lawsuits Nintendo filed against hacker distributors in May. Nintendo has already won a complete case - receiving a $2 million settlement and a permanent injunction against the alleged hacker distributor. In the previous lawsuit, the distributor was accused of trafficking hardware and software made by a hacker group called "Team Xecuter." Two members of the group, Gary Bowser and Max Louarn, were arrested earlier this year and charged with 11 felonies.

As Ars Technica reported in May, as a for-profit organization, unlike the open source, emulation, and maintenance communities, Team Xecuter's efforts in these areas are somewhat controversial.

Nintendo did not explicitly state in Wednesday's court filing that the reseller was selling Team Xecuter products, but noted that it sold RCM injectors with SX OS (Team Xecuter's software) or other similar programs. Currently, Amazon still has many RCM injectors, but the specific listing cited by Nintendo has been removed.
