Attention! Amazon has updated its intellectual property policy. Listings that do not follow this policy may infringe copyright.

All sellers on Amazon know that in order to reduce the risk of infringement, when listing, for some brand words, the brand name cannot appear alone in the title, and must be added with prepositions such as Compatible with and for .

Some time ago, Amazon issued an announcement regarding copyright infringement.

Amazon said it is making changes to its product intellectual property policy to clarify how sellers should indicate compatibility with other brands of products, such as a charging cable that is compatible with a specific brand of phone. If sellers list such products, please check whether the product title meets the new recommendations to indicate its compatibility .

Amazon also emphasizes that for products sold on the platform, the compatibility of the product with the trademarked product should be truthfully stated in the listing title. At the same time, your product title should be designed in accordance with Amazon's brand name policy.

It can be seen from the announcement that Amazon’s updated policy is mainly intended to remind sellers to check product titles in a timely manner to avoid infringement.

That is, if a seller sells a data cable that is compatible with the Kindle E-reader, they can use the brand name "Kindle", but when describing the cable in the listing, they must indicate that it is "compatible with Kindle", and any description must be true and reliable without causing confusion.

The above words may be a little difficult to understand, so let me give you an example.

For example, when describing that a certain brand product is compatible with a certain commodity, in the listing description, we can write:

"Xandu USB charging cable, compatible with iPhone 12, or TonTon Sleeve for Kindle Fire."

In summary, the title format for brand-compatible products is as follows:

[Your product’s brand name] + [Product name] + “for use with” / “compatible with” / “suitable for” / “intended for use with” + [primary product brand] + [primary product name] + (other product title elements, if applicable) ”.

However, friends should note that in the description of the listing, you cannot write: for example, "similar to iPhone 12" or "better than iPhone 12" . If such a description appears, it will violate Amazon's listing policy and will also lead to the risk of infringing products being removed from the shelves.

Amazon has now clearly stipulated the compatibility clauses between products and trademark brands. Therefore, when sellers write the 5-point description, they must follow the format specified by Amazon and remember not to violate Amazon's rules.

If Amazon finds that the seller’s listing title, five-point product features, product description, and Search Term keywords contain infringing information that infringes on brand words, it will impose corresponding penalties.

Final Thoughts

In fact, when it comes to intellectual property rights, sellers are no strangers to them. After all, what they fear most is Amazon’s sudden red flag saying that a product has caused infringement.

After receiving the little red flag, the seller has to file a complaint. If it is not handled properly, he may face many risks such as product removal, cancellation of sales rights, and account closure.

Based on the feedback received from sellers over a long period of time, the editor found that the most common infringement issues on Amazon include trademark infringement, text infringement in listings, and image infringement. Some sellers use emoticons without authorization, not realizing that this may have caused infringement.

Amazon’s announcement is undoubtedly a warning to sellers that infringement is no small matter and the product title is just the tip of the iceberg.

After all, intellectual property covers a very broad scope, and there are tens of thousands of products sold on Amazon, so sellers may fail if they are not careful.
