Amazon may be banned from selling for 7 days


According to people familiar with the matter, many products on Amazon India do not indicate the country of origin . In October this year, the Indian Ministry of Consumer Affairs issued a warning to Flipkart and Amazon because the sellers on their platforms did not comply with the regulation of indicating the country of origin. The two e-commerce platforms must respond within 15 days, otherwise they will face penalties.


According to India's Legal Metrology Act, the fine for a first offense will be 25,000 rupees , the fine for a second violation will be 50,000 rupees, and for more than two violations, the fine will not be less than 50,000 rupees and not more than 100,000 rupees, or the offender may face up to one year in prison.


The Ministry of Consumer Affairs did not respond to an email sent to Amazon regarding the matter. As a first offender, the Bengaluru-based Amazon and each of its directors were fined Rs 25,000 under the provisions of the Measurement Act.


But CAIT said:

It makes no sense for Amazon India to be fined Rs 25,000 by the Ministry of Consumer Affairs and call for ‘exemplary punishment’ by imposing a seven-day ban on Amazon and other large e-commerce platforms that continuously violate laws and policies .


CAIT Secretary General Praveen Khandelwal said:

“Imposing such a small fine on a foreign e-commerce giant for violating Indian laws makes a mockery of our judicial and administrative systems. The punishment should be commensurate with the damage they have caused to our economy and send a clear message to other foreign e-commerce companies that no one should violate Indian laws.”

It is not clear whether Amazon will be required to implement a 7-day ban. However, once a sales ban is implemented, it will have a significant impact on sellers' sales, especially during the holiday shopping season. Sellers on the Indian site will be in trouble. Once implemented, they will be banned from selling for 7 days, which means 0 orders for 7 days .

This incident also reminds sellers not to put all their eggs in one basket, but to try several platforms, otherwise they may end up with nothing.

Amazon may be fined $1 billion for being both a referee and a player


Amazon has been under investigation frequently in recent years. Just in November, Amazon was threatened with a billion-dollar fine by Brussels for violating EU antitrust laws. The lawsuit is just the first step for the EU to ensure fair competition on the Internet.


Earlier, the European Commission informed Amazon of the preliminary results of an antitrust investigation that lasted more than a year. The investigation showed that Amazon profited from the sales of its own products by using the data of third-party sellers on the platform . The European Commission also announced that it would launch a second round of antitrust investigations on Amazon, targeting its Buy Box and Prime membership functions.


Last July, the European Commission officially launched an antitrust investigation into Amazon. After more than a year, on November 10 , the European Commission officially issued a "statement of objection" to Amazon, saying that it had reached a preliminary conclusion:

Amazon must respond to the findings that it illegally abused its dominant market position in Germany and France by using non-public sales data from third-party sellers to profit from its own retail business, with which it competes.

In general, Amazon is both a referee and a player , and may be fined $1 billion by the EU!

As the world's largest online retailer, even if Amazon is fined 1 billion, it is only a drop in the bucket. The key is how to prevent such shameless behavior, which is worth studying.
