Before every big sale, copycat sales become rampant, trying to lower the other party’s big sale prices.



Don't understand operation, follow the sales to make money and run away

Nowadays, some people are posting advertisements on major social media platforms to recruit apprentices to teach how to follow the seller, using a bunch of gimmicks like "no source of goods", "low cost", "exchange rate difference" and "guaranteed teaching". Many people who want to get something for nothing will get involved.

Now it is easy to receive a warning letter if you try to follow others, Amazon will accuse you of abuse, and you will have to write a POA, or even close your store. The best way to avoid following others is to do the Transparency Plan or BG Label .


(1) Amazon Transparency Program

You need to have an R mark. You can ask the investment manager whether you can participate in the Transparency Program. For products of sellers who have registered for the Transparency Program, Amazon will provide a unique QR code. The seller will affix the code to the product packaging. When the product enters the warehouse, Amazon will identify the code and confirm that it is authentic before entering the warehouse. FBA followers cannot get the code, and the goods cannot be sold in Amazon warehouses. When they ship and follow the seller themselves, they will also be required to provide code authentication.


(2 ) Amazon Brand Gating

For products that have successfully passed Brand Gating, if sellers want to follow the sales, they need to provide the manufacturer's invoice and obtain written authorization from the brand. They are also required to pay $1,500 for each brand. This is the most effective way to protect sellers' listings from infringement (following sales).


The "BG mark" has nothing to do with the application method of the trademark. Sellers need to apply for it with Amazon. It is difficult to obtain it now and the requirements are relatively high. Only sellers with a complete scale can apply for it.


In addition to the headaches caused by follow-selling, there have also been a lot of infringement complaints. Last week, many sellers were complained about the infringement of the word "summer" and their listings were removed from the shelves. Many commonly used words were registered, causing sellers to receive complaints before the big promotion, and their products were at risk of being removed from the shelves one by one.

Brand infringement

The seller's listing included the brand words of a competitor. This time it was not Amazon that detected the infringement, but the competitor's seller complained directly. Even if he deleted the brand words himself, it would not work. The only solution was to contact the other party to cancel it.



Especially when your product is bought back by a competitor and you discover infringement, you can complain directly to Amazon. This will provide solid evidence and you will have no choice but to negotiate a settlement and withdraw the claim. There is no way to appeal to Amazon at all.



Patent Infringement

Good products that seem to have few sellers are at the greatest risk of patent infringement. Often, your competitors will start taking action just as your products are gaining popularity or before a big sale, and will complain about you from time to time, causing you to be unable to sell your products and having an inventory backlog.


Recently, a seller encountered such a thing. The product’s appearance infringed on patents, and the listings were complained and removed from the shelves every now and then. He was left with more than a thousand stocks that could not be digested.




Image infringement

The magic operation is shown here in the case of image infringement. Some sellers’ product images were stolen, and the other party directly uploaded them to their own independent website to complain about the seller’s image infringement, resulting in the deletion of the listing image. Now the other party says that they need to repurchase the domain name before they can withdraw the complaint.


This wave of operations is very similar to the recent situation where sellers received notification that their brand’s domain name was preemptively registered by a service provider, and then the Amazon product information was synchronized to the brand’s independent website, and then an in-site letter was sent disguised as the GBC law firm to intimidate the sellers.


Now you can directly complain to Amazon that your images infringe the copyright, and the purpose is to make sellers buy brand domain names at high prices. In this case, sellers have to file a complaint on the domain name registration platform, and on the other hand, they have to file a complaint on Amazon, submitting PSD files of their own images and other information.


In recent years, there have been too many examples of commonly used words being registered as trademarks. However, these complaints also frequently occur before big sales, so sellers must manage their listings carefully recently, and be especially vigilant against malicious follow-selling and various infringements to avoid losses.
