Amazon Prohibited Selling Policy Update

Amazon Japan has released its latest sales ban policy. Amazon said that starting from March 27, 2023, the Japanese site will change the listing policy for "weapons and weapon-like products" on the "Restricted Products Help Page".

While Amazon allows sellers to sell products, some jurisdictions may restrict the export, import, or sale of those products. For example, exporting/importing or otherwise providing certain products or technologies specified in Japan's Foreign Exchange and Foreign Trade Act requires approval from the Ministry of Economy, Trade and Infrastructure.

To this end, the seller is responsible for obtaining all required licenses and permits and for any penalties resulting from non-compliance.

Certain weapons are considered "defense" articles subject to the jurisdiction of the U.S. Department of State and are controlled by the International Traffic in Arms Regulations ("ITAR"). The export of all items subject to ITAR (as defined in the Amazon Services Business Solutions Agreement and 22 CFR 120.1, including release to a "foreign person" within or outside the United States) requires a license, license exemption, or approval from the U.S. Department of State.

Failure to comply with ITAR may result in civil penalties of up to $500,000 per violation, criminal penalties of up to $1,000,000 per violation and 10 years in prison, and/or a ban on doing business with US companies.
