In the cross-border circle, the phenomenon of item names being registered as trademarks is nothing new. This is mainly due to the "forward-looking vision" of some merchants, who successfully transformed specific names into exclusive trademark logos protected by law.

Recently, a number of commonly used words have been registered as trademarks! Huluwa recommends that sellers conduct self-inspections as soon as possible and remove or withdraw cash in time if any inappropriate products are found.


Coins

The word "Coins" is usually interpreted as "coins/money" in Chinese. According to official data from the United States Patent and Trademark Office (USPTO), a considerable number of individuals or companies have tried to register it as a trademark over the years, but most of the applications have expired. As of now, there are four trademarks in effect.


Of the four valid trademark holders, three are companies located in the United States and the United Kingdom, while the other is an individual located in China. It is worth noting that the "Coins" trademark held by this Chinese individual was the one that recently took legal action against the seller.



According to USPTO records, the "Coins" trademark owned by Hong Zhuo gui was registered in 2017, and its registration categories cover multiple categories such as 037, 039, 040, 042, 050, etc., and its main protection scope is limited to the relevant fields of hook and loop fastening tapes.



SUPER BALL

The word SUPER BALL is usually interpreted as "bouncy ball" in Chinese. In the field of cross-border trade, many sellers have encountered problems related to the HulaHoop trademark. It is worth noting that the holder of the SUPER BALL trademark is the same as HulaHoop, both of which are the famous American youth outdoor toy and sports brand "Wham-O".


The trademark was officially registered in 2012 and its protection scope is extremely broad, covering dozens of product categories including Christmas decorations, surfboards, basketball backboards, yo-yos, action figures and accessories, marbles, sports balls, volleyball nets, balloons, discuses, etc.


Although Wham-O has not yet filed infringement lawsuits regarding the SUPER BALL trademark, sellers still need to remain highly vigilant to avoid potential legal risks.



Bacon Bin

Bacon Bin is a kitchen appliance designed to filter grease and preserve lard. It is not only a popular name for the product, but also a registered trademark in the United States. The ownership belongs to Talisman Designs LLC, an American brand famous for its innovative kitchenware.


The brand has recently filed infringement complaints against multiple cross-border e-commerce platforms , such as Ebay, Amazon, AliExpress and Wish, for alleged infringements . The reason for the complaint is that some sellers may have used "Bacon Bin" as the product name without authorization when editing product information, thus triggering trademark infringement issues.

Whether it is a common word, or an infringement of a listing keyword or a product description word, sellers have to take the difficult road of appeal after receiving the platform’s red flag. If it is not handled properly, the listing may be deleted at the least, or the store may be banned from sale or closed down at the worst.


However, according to industry insiders, the US law is such that a complaint may not be effective after review. It also needs to be considered in the specific context. If it is only used as a quantifier, it may not necessarily be an infringement. However, when editing titles and detail pages, we still need to avoid some infringing words in combination with the product to avoid stepping on landmines.


As the platform develops, there will be more and more infringement pitfalls. The best way to deal with the infringement risks brought by common words that have been applied for as trademarks is to avoid them in advance.
