1. Nippon Seal Hair Removal Roller Patent
  • Plaintiff: Nippon Seal (Shenzhen) Co., Ltd.
  • Case Number: 24-cv-11211
  • Prosecution date: October 30, 2024
  • Reason for prosecution: Patent infringement
  • Court: United States District Court for the Northern District of Illinois
  • Law firm: Dewitty

The plaintiff has a well-established business in the textile sector, specialising in a wide range of items, from industrial fleece fabrics to fleece fabrics for passenger seats in vehicles.

However, the plaintiff’s best-known product is a special non-electric multi-purpose cleaner called the Nippon Seal Pac Pak Roller, which is superior at capturing tiny particles compared to traditional tools such as vacuum cleaners or sticky carpet cleaners.

To use it, users simply move the cleaner back and forth like a mop to easily remove dirt. When you are done cleaning, simply lift the lid to quickly remove the garbage inside.

Unlike vacuum cleaners that rely on electricity to operate and tape rollers that require frequent replacement of adhesive sheets, the Nippon Seal Pac Pak Roller requires neither electricity nor adhesive sheets, making it extremely environmentally friendly.

The core of this case revolves around the patent of this product, the patent number is US 8,117,706 B2, which was officially authorized on February 21, 2012.

It is worth noting that on the Amazon platform, a product with similar functions to Nippon Seal Pac Pak Roller has a monthly sales volume of up to 50,000 units . The product has received enthusiastic market feedback and has won praise from many consumers.

Given that the plaintiff has not yet filed a TRO, sellers involved in sales should conduct self-inspections as soon as possible to ensure the compliance of their products.

At the same time, Let's Color ink pad is also very particular about the material selection. It is made of environmentally friendly sponges and non-toxic ink, ensuring that the product is non-toxic, odorless and washable, giving users more peace of mind during use.

However, recently, the infringement of the Let's Color trademark has attracted much attention. The plaintiff has filed an appeal to protect its own rights and interests. The trademark involved is shown in the figure below:

Although the trademark was not officially registered until July 30, 2024, the plaintiff stated in the complaint that the trademark had been in commercial use since May 19, 2016. Therefore, sellers who use the trademark after that date need to be extra careful to avoid the risk of infringement.

When searching for Let's Color related products, you can find a large number of sales links on e-commerce platforms such as Amazon and eBay.

Taking Amazon as an example, the highest monthly sales volume of related products has exceeded thousands, which shows the sustained and popular market performance of this product.

At present, the plaintiff has not filed a TRO, and sellers of related products are advised to conduct thorough investigations.

While pursuing product diversification, Anagram also attaches great importance to sustainable development. In order to reduce the impact on natural resources, the brand has launched a series of environmentally friendly product lines, including balloons that use 40% less helium to inflate.

In addition, Anagram has redesigned its product packaging, actively practicing environmental protection by reducing material use, adding recyclable paper, and introducing recyclable paper straws. These measures have won wide acclaim from consumers.

Anagram is equally firm in its attitude towards intellectual property protection. This year, the brand has filed several lawsuits to crack down on trademark and copyright infringements.

This case mainly involves the copyright of Anagram. The following are some of the copyrighted images involved:

Moreover, according to the query results, there is a lot of copyright information registered under the name of the plaintiff, and the relevant product pictures are protected by law. Any unauthorized use may constitute infringement.

It is worth noting that Anagram has also done a good job in trademark protection. It owns multiple trademarks, all of which are registered in 28 categories (toys, games and sporting goods) .

In October alone, Anagram filed six lawsuits involving trademarks and copyrights (24-cv-10915; 24-cv-10780; 24-cv-10791; 24-cv-10794; 24-cv-10653; 24-cv-09741) .

In general, "no matter how small the infringement is, it is a big deal". Nowadays, e-commerce platforms such as Amazon, Shein, and TikTok Shop pay more and more attention to intellectual property rights. Therefore, sellers should also be vigilant in their business operations, prevent infringements, and strengthen their awareness of self-protection.
