Amazon's new anti-sell plan! Anyone can delete the hijacked products? !


Amazon's original intention of setting up the follow-selling function was good, but it could not resist the abuse of some people. Now follow-selling has become a problem that everyone wants to stop, and Amazon must bear the blame for its insufficient supervision and crackdown.


It is basically impossible to directly remove the follow-selling mechanism, and we can only work hard to suppress counterfeit and knockoff products. Therefore, Amazon's various anti-counterfeiting plans are emerging one after another.


From the Exclusive Plan, the Transparency Plan, to the recently launched Zero Plan , all are attempts to protect legitimate sellers from being affected by counterfeit and copycat products.



However, except for the zero plan, the other two methods are to prevent counterfeit sales by making it more difficult to follow the sales. For counterfeit and copycat products that already exist on the platform , what methods can ordinary sellers use to protect their products from being copied and sold?


According to foreign media reports, in response to this situation, Amazon has begun testing a new anti-copycat plan.



What does this plan entail?

The main content of this plan (tentatively named "the Utility Patent Neutral Evaluation Process", which we will call the Neutral Evaluation Plan for short) is to directly open lawyer consultation and agency rights protection functions to third-party sellers.


When a seller finds that his or her products are being copied or other stores are copying his or her products, he or she can use this function to provide relevant information to the lawyer. The lawyer will evaluate the application submitted by the seller and decide whether to delete the copycat products.


After reading this general process, you will find that you originally thought that contacting a lawyer would mean going through legal procedures, but you didn’t expect that the lawyer would directly determine whether there is infringement and Amazon would delete the product.


Therefore, in this plan, the lawyer is equivalent to an Amazon staff with professional intellectual property business capabilities, who will judge each application submitted by the seller one by one.


A third-party lawyer plays the role of this professional


Compared to simply going through legal procedures, the judgment process of this new plan is very fast and will not affect the fairness of the judgment.


Those who have seen the previous Zero Plan may find this operation familiar (click here for details of Zero Plan). Yes, the core of Zero Plan is also to directly delete the copycat products.


The zero plan gives brands the right to directly delete counterfeit listings. The method is direct and crude, but only some well-known international brands can participate . This plan has no practical significance for us small and medium-sized sellers.


The reason why we cannot participate in the zero plan is that small and medium-sized sellers do not have the necessary relevant professionals, and the brand credibility is not enough to support such a great right.


In the neutral evaluation plan, an official lawyer with professional knowledge and skills is used to review the infringement applications filed by small and medium-sized sellers, which can solve the above problems of small and medium-sized sellers and truly allow all sellers to delete the counterfeit listings/follow-selling of their products.


How can this plan be implemented?


How can such a powerful function be realized? Can the seller submit an application directly and let the lawyer review it? As we all know, American lawyers charge sky-high fees, and my brother-in-law is unlikely to pay this money for us.


According to information revealed by an Amazon spokesperson, to initiate a neutral evaluation case, the applicant needs to pay a deposit of US$4,000 (isn’t it super expensive? Read on).


After the deposit is paid, Amazon will notify the defendant seller. At this time, the defendant has two options. The first is to ignore it, and the second is to file an appeal and submit patent information for the lawyer to decide who will win.


In the first case, the applicant will be directly judged as the winner , the defendant seller will directly delete the relevant products, and the deposit of $4,000 will be returned to the applicant .


In the second case, the defendant seller also has to pay a $4,000 deposit to file an appeal. After that, the lawyer will judge and review the case and make a final decision. The winner can get his $4,000 deposit back, while the loser will have his deposit confiscated (if the defendant loses, the product will be deleted).

How do you evaluate this plan?


The cost of operating the neutral evaluation program is really high. If you file an infringement complaint, if you are found to be unsuccessful, your deposit will be confiscated. This will also ensure that sellers will carefully consider before submitting an application, and will never use it in ambiguous situations.


As for products that are obviously infringing, copycat sellers or shanzhai sellers will basically not file a complaint due to considerations of the product and the appeal deposit. Sellers can also delete the infringing listings or drive away copycat sellers at no cost.


Amazon also stated that it has been testing this feature since last fall, and if the test results are good, it will be widely promoted to all sellers. This feature will effectively and fatally combat follow-selling and counterfeiting.


However, I think we are still in an ambiguous situation most of the time. For those who are not brave enough to use the neutral evaluation plan or who need to stop copycat sales right now , the transparent plan would be more practical.
