Infringement incidents occur every month, and there are particularly many in recent days.

1000+ stores were frozen and fined, these words can no longer be used

Listing is the key to facilitating orders, but it is also a high-risk area for mistakes. If a word is used improperly, you may be sued for infringement, which may result in the product being removed from the shelves or frozen and fined.

Recently, more than 1,000 stores have been blocked from listing and their funds have been frozen. The words include Hygiene Hand, UNO, Kareem Abdul-Jabbar, ONE SECOND NEEDLE, KTM, etc.

Hygiene Hand

Hygiene Hand is a "hot product" during the epidemic , allowing consumers to open doors and press elevator buttons without contact, preventing virus infection.
Hygiene Hand has been registered as a trademark and was approved on December 22, 2020:
After the trademark registration was successful, the brand immediately cracked down on trademark infringement. It is reported that 869 stores have been affected. The word cannot appear in the listing and product pictures, and sellers should be careful to avoid it.

UNO

UNO playing cards is a popular board game. We filed a lawsuit in February to protect our rights. If the word UNO is printed on the listing or the outer packaging of the product, there is a very high risk of infringement.

In addition to UNO , the plaintiff company Mattel's Barbie dolls and Thomas & Friend trains have also filed lawsuits to protect their rights, and the corresponding trademarks, pictures and product images need to be "avoided".

Kareem Abdul-Jabbar

Kareem Abdul-Jabbar, a former American professional basketball player, word trademarks, pattern logos, etc. are infringement minefields.

In addition, ONE SECOND NEEDLE, a sewing tool that makes threading a needle easier, filed a lawsuit for infringement in early March. The reason for the infringement was trademark infringement.
KTM is an Austrian motorcycle manufacturer. In the past two years, it has frantically filed cases to protect its rights, with a total of 9 cases.
Therefore, sellers, please note that words such as Hygiene Hand, UNO, Kareem Abdul-Jabbar, ONE SECOND NEEDLE, KTM, etc. cannot appear on your listings.

Patent Infringement Warning: Best Seller Mobile Phone Tripod

Mobile phone tripods have been a hot-selling product in recent years. Especially due to the impact of the new crown, more young people like to share videos through self-media while staying at home, so the sales of matching selfie sticks and gimbals have also ushered in explosive growth.

Recently, many sellers want to know the patent status of selfie stick tripods. When I was browsing Amazon US recently, I saw a mobile phone tripod. It is the #1 Best Seller in Complete Tripod Units on Amazon US, priced at US$20.39, with 8354 stars.

The design of this product is quite good, and the core design points are: the buckle design of each telescopic unit; and the top mobile phone fixing and folding device. Through these two designs, you can quickly switch between the selfie stick and the tripod, and at the same time provide multiple widths of mobile phone viewing angles and tripod height support.

For this type of product, a patent search was conducted in the United States, and it was found that the design does have a U.S. appearance patent, and the patent was newly authorized on 2021.02.02.

Sellers, please note that the protection period of U.S. design patents is 15 years from the date of authorization. As long as the authorization is granted, it is absolutely valid. There are a large number of sellers selling similar designs on Amazon’s U.S. site, and the risk of infringement is not small.

Ningbo Customs seized 5,900 infringing beauty products

Cosmetics and skin care products are a "must have" in life for many women who love beauty. However, fake and inferior beauty products not only fail to achieve the effect of beauty and skin care, but may also cause serious harm. On March 12, Beilun Customs under Ningbo Customs was investigating a case involving suspected infringement of a batch of beauty products.
It is understood that when the Beilun Customs inspection officers were inspecting a batch of artificial trees, plastic floor mats, stainless steel teapots and other goods declared by a company for export to the UAE, they found that the goods included foundation with the trademark "BENEFIT", facial masks with the trademark "MAC and Picture", and foundation with the trademark "ESTEELAUDER".
After careful counting, the customs issued a total of 5,900 pieces of cosmetics from six brands, including "HUDA BEAUTY", "BENEFIT", "MAC and Figure", "ESTEE LAUDER", "BIODERMA" and "ESSENCE:E" , with an estimated value of about RMB 500,000 based on genuine products. However, after contacting the trademark rights holders, it was confirmed that these goods were all infringing and counterfeit goods.
A relevant official from Ningbo Customs said that since last year, Ningbo Customs has seized more than 1 million infringing beauty products and imposed fines of more than 4 million yuan.
Sellers must pay attention to infringement issues, as the consequences may range from fines to account suspension .
