What is FP? FP Evaluation

What is FP? FP Evaluation

FP is the pinyin abbreviation of counterfeit goods, which is what we often call knockoffs. Selling infringing products or counterfeit goods on Wish platform will result in product removal and fines, or even account freezing.

FP judgment criteria

1. Directly copy or imitate a product that implies intellectual property.

2. The product name is identical to or essentially indistinguishable from the name of the intellectual property owner.

3. Product images contain photos of celebrities or well-known models.

How to self-check

1. Use search engines such as Baidu and Google to directly search for brands, brand logos or labels.

2. If there are no logos, brand names or labels in the image or listing text, you can use a "reverse image search" such as TinEye.

3. Check common illegal counterfeit products directly on the wish platform.

risk

1. Legal risks.

2. Risk of fines.

3. Infringement complaints from foreign law firms will freeze store payments and the store will face high settlement fees.

4. Store performance fluctuates greatly and cash flow is unsustainable.

Penalty Policy

1. When a product is in the pending review status, if it is determined by the Wish review team to be a counterfeit product, the illegal product will be removed from the shelves and the store will lose its integrity qualification.

2. When a product is on sale, if the Wish review team determines that it is a counterfeit product, the product will be removed from the shelves and lose its integrity store qualification. Wish will also withhold the current outstanding payment for the counterfeit product on sale and impose a certain penalty.

3. If the products sold are determined to be counterfeit products by the Wish review team, Wish officials will require the buyer to send the goods back to Wish's US headquarters.

4. Products from honest stores are sold directly without review, but Wish's review team will conduct spot checks on products from honest stores. If counterfeit products are found in the store, the products will be removed from the shelves and the payment will be temporarily withheld.

5. When one of your products sells very well, the copyright owner is likely to register the copyright and may ask the platform to remove all unauthorized products. At this time, Wish will remove all other uncopyrighted products.

Common counterfeit content

1. Pictures. Pictures are the most common examples of counterfeits. The following three types are common.

1. Products that are difficult to identify: Such products are directly marked as imitations.

① Brand logo or name: If there is a brand logo or name on the product, it will be marked as a counterfeit.

② Similar to a big brand: If the logo on the product is very similar to the brand, it will be marked as a counterfeit.

③Mosaic: If there are obvious blurred areas or correction brush marks, it will be marked as a counterfeit.

④ Counterfeiting the core elements of a brand: For example, if a brand has registered a trademark for a checkered style, counterfeiting the core elements will be marked as a counterfeit.

⑤Celebrity style: A celebrity appears in the picture

⑥ Adding brands to the background: Adding boxes, hangers, etc. with brand logos to product images will be marked as imitations.

2. Suspected products

①Hidden Figure: Blurring the model’s face, or not showing her face at all, usually indicates that the product is a replica

②Supermodels or suspicious pictures: If there are supermodels in the pictures or the pictures look like they are professionally designed for other brands, the product may be a replica

3. Edge products

① Accessories and peripherals: Some accessories, such as mobile phone cases and pendants, may appear as brand-name products in product images. If it is clear from the title and product description that the product is an accessory and not an electronic product in the image, it will not be marked as a counterfeit.

② Marginal low-end brands: There are many domestic low-end brands on the Wish platform, such as watches, sunglasses, cosmetics, etc.

Wish will directly mark the above difficult-to-identify products as counterfeits, and will carefully review suspicious and marginal products.

2. Copywriting. The Wish official system will automatically scan the copywriting parts such as product titles, tags, and descriptions. If they contain officially protected brand words, your product will most likely be listed as a counterfeit product. The hit rate is very high, so everyone must avoid it.

3. Sensitive categories. Sensitive categories are categories that Wish does not allow to be sold. The prohibited categories are as follows.

How to avoid

1. Create content that is truly your own: Do not steal/borrow images or content from other sources.

2. Selling branded products: If you have legal authorization for a certain brand, you can display the brand information in the title or description, which is very attractive and a plus point. If you do not have legal authorization to sell branded products, you cannot mention the brand in the title or description.

3. Make sure the product listing information is authentic: Make sure the product source is legal; if you are not sure about the source of the product, do not upload the product on Wish.

develop

-Starting from September 22, 2014, Wish will impose severe fines on merchants who sell counterfeit products. In serious cases, Wish platform will terminate cooperation with them.

-Wish launched a new "counterfeit product review" mechanism on March 3, 2015. Merchants can view the relevant review status on the backend homepage and check whether the counterfeit product rate of the store is within 0.5%. If it is within 0.5%, the store will be displayed as a "trusted store".
